Real estate was profoundly altered in 2020.  That's true for everybody, but even more so for real estate. The pandemic created one of the hottest and strangest markets in history, but it also accelerated trends that have been in place for years and years.  Furthermore, changes in the legal environment (commission lawsuits, DOJ action) and a new Administration brings major shifts in the horizon, right after a year in which race and fair housing was prominent within the industry.

At the same time, we have two major players moving into the industry: CoStar, which acquired Homesnap, and Social Capital, which acquired Opendoor.  Compass is resurgent.  eXp is breaking growth records.  These are chaotic times, after the flood.  What does a broker need to think about going forward?

Every real estate transaction presents potential legal pitfalls.  Buyers and sellers may bring suits against their brokers or agents, based on both statutory and common law, for a variety of reasons, including misrepresentation or nondisclosure of property conditions, breach of fiduciary duty, and unlawful discrimination, to name a few.  Combine the strong housing market with an increasing litigious society, and you have the recipe for lawsuits.  To avoid legal pitfalls familiarize yourself with these types of claims and how to avoid them.
