Fair Housing Disclosure Requirement Takes Effect April 3
Beginning April 3, 2026, Ohio licensees representing sellers must present and obtain a signed Fair Housing Disclosure form before marketing or showing a property. REALTORS® should plan ahead to ensure compliance.
Where can I find the form?
This form has not yet been released, but the Division of Real Estate is working on it and will release it before the effective date. It will be found on the Division's website, and we will continue to share updates as we receive them.
Is it a new, standalone form?
Yes, it is a standalone form that comes from the State of Ohio, similar to the agency disclosure statement.
When do I have the seller sign the form?
The Fair Housing Disclosure form must be presented prior to marketing or showing the property. Its purpose is to educate sellers about federal and state fair housing laws and to clearly state that discrimination in the sale of housing is illegal.
Does this apply to commercial properties?
No, this law only applies to residential listings.
Does a buyer need to sign the form?
No, this form is only for residential sellers.
What if a seller refuses to sign?
Ohio law requires this form to be presented by a real estate licensee, and that licensee cannot represent the client if they refuse to sign. A buyer does NOT need to sign the form; only residential sellers are required to sign.
What is this for?
The Homebuyers Protection Act requires sellers to sign a document acknowledging their awareness of housing discrimination laws and the associated penalties before working with a real estate professional.
When was it created and why?
HB 315 included language called the Homebuyers Protection Act, which requires sellers to sign a document acknowledging they are aware of the housing discrimination laws, as well as associated penalties, before they can work with a real estate professional.
This law takes effect on April 3. Any real estate licensee who fails to comply will be subject to disciplinary action and fines. The Division of Real Estate will provide additional information, and we will share updates as they become available.
